Overview
Welcome to wynn + wilde. The terms “we”, “us” and “our” refer to wynn + wilde.
wynn + wilde operates this store and website, including the information, content, features, tools, products and services made available through it (the “Services”). wynn + wilde is powered by Shopify, which enables us to provide the Services.
These Terms of Service (“Terms”), together with the policies referenced in them, describe your rights and responsibilities when you access or use the Services or place an order with us.
Please read these Terms carefully before using our Services or placing an order.
By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access the Services.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights available to customers in Australia under the Australian Consumer Law.
1. Access and account
By agreeing to these Terms, you represent that you are at least the age of majority in your state, territory, province or other jurisdiction of residence, or that you have any consent required by applicable law to use the Services.
To use the Services or purchase our products, you may be asked to provide information including your email address and billing, payment and delivery information.
You represent that the information you provide is accurate, current and complete and that you have the necessary rights to provide it.
If you create an account, you are responsible for maintaining the security of your account credentials and for activity undertaken through your account.
You may use the Services only for lawful purposes and in accordance with these Terms.
2. Our artwork
Every wynn + wilde artwork is individually created from a photograph you provide as a custom artwork of your specific pet, then made to order in the collection, palette, size and frame you select.
Our collections are stylised artistic interpretations rather than photographic reproductions. Each has its own visual language, and the appearance of your finished artwork will reflect both the photograph you provide and the characteristics of your selected collection.
We make reasonable efforts to represent our artwork, colours, materials and finishes accurately on our website. However, colours and appearance may vary between screens and devices, and slight differences may occur between digital representations and the finished printed artwork.
The natural characteristics and texture of fine art paper, printing and framing materials may also be visible in the finished piece and are not necessarily defects.
Product descriptions, specifications and availability may change from time to time. Any changes will not alter an order we have already accepted unless agreed with you or otherwise permitted by law.
3. Your photograph
Your artwork is created from the photograph you provide. You are responsible for selecting a photograph that shows your pet as you would like them to appear in the finished artwork.
Your artwork will reflect your pet’s pose, position, expression and visible details in the photograph you provide. Collars, harnesses, bandanas and other accessories visible in your photograph may therefore appear in the finished artwork.
We do not change your pet’s pose or expression, create details that are not visible in the photograph, or combine multiple photographs to create a single image.
Our Photograph guidelines explain how to select a suitable photograph and the image quality and composition needed for the best result.
We review the photograph you provide before proceeding with your commission. If we determine that it is unsuitable, we may ask you to provide another photograph.
If you cannot provide a suitable photograph, we may decline the commission and refund any amount you have paid.
4. Rights to your photograph
By uploading, emailing or otherwise providing a photograph to us, you confirm that:
- You own the copyright in the photograph or have permission from the copyright owner to use the photograph for the creation of your commissioned artwork
- You have all other rights and permissions reasonably necessary for us to use the photograph to create and fulfil your artwork
- Our use of the photograph for that purpose will not infringe another person's copyright, privacy or other rights
You grant wynn + wilde a limited, non-exclusive licence to use, reproduce, adapt and process the photograph only as reasonably necessary to create, review, produce and fulfil your artwork, provide customer service and meet our legal obligations.
You or the relevant copyright owner retain ownership of the original photograph.
We will not use your photograph, commissioned artwork or pet’s name for advertising, social media or other promotional purposes without your permission.
5. Orders and acceptance
When you place an order, you are making an offer to commission and purchase a custom artwork from wynn + wilde.
The automated email sent after checkout confirms that we have received your order. It does not constitute acceptance of your commission.
We will review the photograph you provide and accept your order once we confirm that your photograph is suitable and your commission can proceed.
If we require another photograph, we will contact you using the details supplied with your order.
If we cannot accept your order, including because a suitable photograph cannot be provided, we will notify you and refund any amount you have paid for the order.
Before submitting your order, you are responsible for checking your:
- Collection
- Palette
- Size
- Frame
- Pet-name spelling
- Photograph
- Delivery address
We reserve the right to decline an order where we reasonably cannot fulfil it, where we suspect fraud or unlawful activity, where information necessary to complete the commission has not been provided, or where there has been a genuine pricing or product error.
6. Artwork reviews
If you add an artwork review to your order, we will send your artwork to you for review before it is submitted for printing.
Your artwork review includes the opportunity for one minor refinement.
A minor refinement may include correcting a marking we have interpreted incorrectly, correcting your pet's name, or making a small adjustment to the placement or crop of the existing artwork.
A different photograph, different collection, change to your pet's pose or expression, addition or removal of accessories, change of palette, or substantial redesign is not considered a minor refinement.
Once you approve your artwork, we generally cannot provide a remake or refund because of something that was clearly visible in the version you approved, such as its composition, crop, palette, treatment of visible markings or pet-name spelling.
This does not apply to printing or framing faults, transit damage, an error introduced after approval, or any other matter for which you have rights under applicable consumer law.
For customers in Australia, approving an artwork review does not limit your rights under the Australian Consumer Law.
7. Recognisability
Although each wynn + wilde collection is a stylised interpretation, your pet should be recognisable as your pet.
Our recognisability standard is that the distinguishing markings and visible details that make your pet individual should be carried into the artwork sufficiently for the finished piece to reasonably read as your pet based on the photograph you provided.

8. Changes and cancellations
If you need to change or cancel your order, contact us as soon as possible at hello@wynnandwilde.com.
You may cancel your order for a full refund at any time before we begin creating your artwork.
Because your artwork is individually created as a custom artwork of your specific pet, once creation has begun we cannot accept cancellations for change of mind.
Before creation begins, you may change your photograph or collection without charge.
Once creation has begun, supplying a different photograph or changing to another collection means beginning a new commission and may result in an additional charge.
Your size, frame, palette, pet-name spelling and delivery address may be changed until your artwork is submitted for printing, provided the requested change does not require the artwork itself to be recreated.
Once your artwork has been submitted for production, it cannot be changed or recalled.
If we cancel your commission because we cannot fulfil it, we will provide a full refund.
Nothing in this section limits any cancellation, refund or other right you may have under applicable law.
9. Prices and payment
Prices, discounts and promotions may change without notice. The price applicable to your order will be the price displayed at checkout when you place the order, subject to the correction of genuine errors.
Applicable taxes, shipping charges and other unavoidable charges will be displayed during checkout where required.
You agree to provide current, complete and accurate purchase, payment and account information.
You represent that you are authorised to use the payment method provided and agree to pay the charges associated with your order.
10. Production, shipping and delivery
Every wynn + wilde artwork is made to order.
Estimated production and delivery timeframes are provided on our website and in our Shipping policy. These timeframes are estimates and may be affected by carrier delays, peak periods and circumstances outside our reasonable control.
If we become aware of a material delay affecting your order, we will contact you and provide a revised timeframe and any options available or required under applicable law.
Tracking information will be provided when your artwork is dispatched where tracking is available.
You are responsible for providing a complete and accurate delivery address. We may not be able to change an address once your artwork has been submitted for production.
Our Shipping policy contains further information about production, delivery, tracking, address changes, lost parcels and damaged deliveries.
Nothing in this section limits any rights you have where goods are lost, damaged or delayed under applicable law.
11. Returns and refunds
Because every wynn + wilde artwork is created specifically for you as a custom artwork of your specific pet and cannot ordinarily be resold, we do not accept returns, exchanges or refunds for change of mind.
This does not affect your rights where an artwork is damaged, faulty, incorrect, materially different from an artwork review you approved, does not meet our recognisability standard, or where you otherwise have rights under applicable consumer law.

12. Intellectual property
The Services and their content, including wynn + wilde branding, collection names, designs, graphics, text, photography, video, audio and other materials, are owned by or licensed to wynn + wilde and are protected by applicable intellectual property laws.
You may access and use the Services for your personal, non-commercial use. Unless expressly permitted by us or applicable law, you must not reproduce, distribute, modify, republish, sell or commercially exploit our website or its content.
Unless otherwise agreed in writing, wynn + wilde retains copyright and other intellectual property rights in the commissioned artwork we create, to the extent those rights subsist under applicable law.
Purchasing an artwork gives you ownership of the physical product and the right to enjoy it for personal, non-commercial purposes. Purchasing the physical artwork does not transfer copyright in the artwork to you.
You may photograph your artwork, display it in your home and share photographs of it for ordinary personal, non-commercial purposes.
You must not reproduce the artwork for commercial purposes, sell reproductions, create merchandise from it or otherwise commercially exploit it without our prior written permission.
Nothing in these Terms transfers to wynn + wilde ownership of copyright in the original photograph you provide.
13. Optional tools and third-party links
We may provide access to tools, functionality, content or links supplied by third parties.
We do not control third-party websites or services and are not responsible for their content, accuracy or practices except to the extent required by applicable law.
Your use of third-party tools and services may be subject to the relevant provider's own terms and privacy policies. You should review those terms before using them.
We may introduce new features, tools or resources through the Services from time to time. Unless otherwise stated, they will form part of the Services and be subject to these Terms.
14. Relationship with Shopify
wynn + wilde is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with wynn + wilde. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and wynn + wilde, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with wynn + wilde.
15. Privacy
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because our store is hosted by Shopify, Shopify collects and processes certain personal information relating to your access to and use of the Services. Information you provide may also be shared with service providers involved in operating our store, processing payments, creating artwork, printing and framing orders, delivering products and providing customer service.
Some service providers may be located in countries other than the country in which you live.
Please review our Privacy Policy for more information about how your personal information is collected, used, disclosed and protected.
Shopify's own processing of personal information is also subject to its applicable privacy policy.
16. Feedback and reviews
If you voluntarily provide feedback, suggestions or a review, you confirm that you have the right to provide it and that it reflects your genuine experience where applicable.
Your feedback must not be unlawful, misleading, defamatory, infringing or otherwise violate another person's rights.
You grant us a non-exclusive, worldwide, royalty-free licence to use and reproduce written feedback or reviews you voluntarily provide in connection with operating, improving and promoting wynn + wilde, subject to applicable law.
Providing feedback or a review does not give us permission to use your photograph, commissioned artwork or pet's name for advertising, social media or other promotional purposes. We will obtain your permission separately before doing so.
We are not required to publish every review or piece of feedback, but we will not unlawfully manipulate, misrepresent or suppress customer reviews.
17. Errors, inaccuracies and omissions
Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, availability or other information.
We may correct genuine errors and update information where reasonably necessary.
If an error materially affects an order you have already placed, we will contact you and deal with the order fairly and in accordance with applicable law.
18. Prohibited uses
You may use the Services only for lawful purposes.
You must not use the Services to:
- Engage in unlawful, fraudulent or malicious activity
- Infringe our intellectual property rights or those of another person
- Upload or transmit malicious code
- Interfere with or circumvent the security or operation of the Services
- Unlawfully collect personal information about others
- Impersonate another person or entity
- Submit false or misleading information
- Send spam or other unauthorised promotional communications
- Reproduce, scrape, extract, sell or commercially exploit substantial portions of our Services or content without permission
- Otherwise use the Services in a way that materially harms wynn + wilde, Shopify, our customers or another person
We may restrict or terminate access to the Services where reasonably necessary in response to misuse, unlawful activity or a material breach of these Terms.
19. Consumer guarantees and warranties
Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, condition, right or remedy that cannot lawfully be excluded, restricted or modified.
For customers in Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Except for rights and warranties that cannot lawfully be excluded and any commitments expressly made by wynn + wilde in these Terms or our policies, the Services are provided on an “as is” and “as available” basis to the maximum extent permitted by law.
We do not guarantee that access to our website will always be uninterrupted, timely, secure or error-free.
20. Limitation of liability
To the maximum extent permitted by applicable law, wynn + wilde and its directors, employees, contractors and service providers will not be liable for indirect, incidental, special or consequential loss arising from your use of the Services where such liability may lawfully be excluded.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, or excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
21. Indemnification
To the extent permitted by law, you are responsible for losses, liabilities, damages and reasonable costs incurred by us as a direct result of:
- Your material breach of these Terms
- Your unlawful use of the Services
- Your infringement of another person's rights
- Your provision of a photograph where you did not have the rights or permissions required under section 4
Nothing in this section requires you to indemnify us for losses caused by our own unlawful conduct, negligence or breach of these Terms.
22. Termination
We may suspend or terminate your access to the Services where reasonably necessary because of unlawful activity, fraud, misuse of the Services or a material breach of these Terms.
Termination of access to the Services does not affect rights or obligations that arose before termination or provisions that by their nature should continue after termination, including provisions relating to intellectual property, liability and outstanding payment obligations.
23. Severability
If any provision of these Terms is determined to be unlawful, void or unenforceable, it will be enforced to the maximum extent permitted by law or severed to the extent necessary.
The remaining provisions will continue in effect.
24. Waiver and entire agreement
If we do not immediately exercise or enforce a right under these Terms, this does not constitute a waiver of that right.
These Terms, together with the policies and other terms expressly incorporated into them, constitute the agreement between you and us relating to your use of the Services and purchase of our products, subject to any rights that cannot lawfully be excluded.
25. Assignment
You may not transfer your rights or obligations under these Terms without our prior written consent, except where applicable law provides otherwise.
We may transfer our rights and obligations under these Terms as part of a genuine sale, transfer or restructuring of our business, provided doing so does not reduce your rights in relation to an existing order or under applicable law.
26. Governing law
These Terms are governed by the laws of Victoria, Australia.
Nothing in this section deprives you of any mandatory consumer protection or right available to you under the laws applicable where you live.
Subject to those rights, the parties submit to the jurisdiction of the courts of Victoria, Australia and courts entitled to hear appeals from them.

We may update these Terms from time to time to reflect changes to our Services, business practices or legal obligations.
Where required by applicable law, we will notify you of material changes.
Changes will apply prospectively from their stated effective date and will not reduce your contractual rights relating to an order already accepted unless permitted by law or agreed with you.
